Introduction to Law

Law is a system of rules created and enforced by social or governmental institutions to regulate behavior. It serves multiple purposes, including maintaining order, resolving disputes, protecting liberties, and promoting justice. The essential characteristics of law include universality, enforceability, adaptability, and its binding nature on individuals and institutions. The primary sources of law include legislation enacted by governing bodies, customary practices accepted by societies, and judicial precedents set by court rulings. The functions of law in society range from establishing social norms and regulating conduct to
ensuring justice, maintaining peace, and facilitating orderly development.

Evaluation and theories of law examine the fundamental principles that shape legal systems. The historical development of law traces the evolution of legal concepts from ancient codes to modern legal frameworks, highlighting the transition from customary practices to codified regulations. Natural law theory asserts that law is based on inherent moral principles and universal justice, whereas legal positivism argues that law is determined by enacted rules and social conventions, independent of morality. Realist theories of law emphasize that law is not just a set of abstract rules but is shaped by social, economic, and political factors, with judicial decisions influenced by practical realities rather than strict legal doctrines.

The Islamic legal system is derived from the Quran, Hadith, and interpretations by scholars, guiding legal principles in many Muslim-majority countries. Hybrid legal systems incorporate elements from multiple  legal traditions, blending aspects of common law, civil law, religious laws, or customary laws, adapting to the diverse legal needs of a country.
